These Terms of Service ("Terms") govern your use of Poppins On-Demand Childcare's website, mobile apps, and childcare services (together, the "Service"). By creating an account, booking care, or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use Poppins
You must be at least 18 years old and the legal parent or guardian of any child you book care for, or have written authorization from that child's parent or guardian. By creating an account, you confirm both. The Service is intended for use in Utah and is not directed at residents of jurisdictions where it isn't offered.
2. The service we provide
Poppins is a Utah-based childcare provider. We employ caregivers as W-2 employees and arrange care at our facilities. All caregivers are background checked and CPR and first aid certified before they're assigned to bookings.
We're the direct provider of the care. We're not a marketplace connecting you with independent sitters. The caregivers who care for your child are our employees, and we're responsible for their conduct in the course of their work.
3. Your account
You're responsible for keeping your account credentials secure and for everything that happens under your account. Tell us right away at info@poppinschildcare.com if you suspect unauthorized access.
You agree that the information you give us, including everything about your child (allergies, medical notes, emergency contacts, pickup authorizations), is accurate, current, and complete. We rely on what you tell us to care for your child safely. If anything changes, update your account before your next booking.
4. Bookings and payment
Pricing. Care is billed per booking at the rates shown in the app at the time of booking. Rates may vary by location, time of day, day of week, child age, and number of children. The total for your booking is shown before you confirm.
Payment. Payments are processed through Wix Payments. By booking, you authorize us to charge the payment method on file for the booking total, plus any applicable taxes, surcharges, or additional fees described below. You're responsible for keeping a valid payment method on file.
Additional charges. You may be charged for: bookings that run past the scheduled end time; reimbursable expenses you authorize a caregiver to incur on your behalf (meals, activity fees); and damages or excessive cleaning fees if care is at our facility and there's clear, documented damage caused during the booking.
Failed payments. If a charge fails, we may pause your account until the balance is resolved. We may use a third-party collections service for unpaid balances after reasonable notice.
5. Cancellations, no-shows, and rescheduling
Our current cancellation, no-show, and rescheduling policy, including any fees that may apply, is published at poppinschildcare.com and is incorporated into these Terms by reference. We may update that policy from time to time. The policy in effect at the time you confirm a booking applies to that booking.
If Poppins cancels a booking (for example, due to caregiver illness or other circumstances on our end), we'll let you know as soon as possible, refund the booking in full, and do our best to arrange a replacement caregiver if you want one.
6. Your responsibilities as a parent or guardian
You agree to:

Be honest and complete about your child's medical conditions, allergies, behavioral needs, and anything else relevant to their care. Failure to disclose something material is a breach of these Terms and can result in account termination.

Provide accurate emergency contact information and authorized pickup persons.

Be reachable during a booking by phone, in case of emergency.

Show up on time for pickup, or arrange an authorized alternate.

Treat caregivers with respect. Harassment, abuse, or unsafe behavior toward our employees is grounds for immediate account termination.

For in-home bookings: provide a reasonably safe environment for the caregiver and child, including any equipment or supplies needed.
7. Health and safety
If your child is sick with a contagious illness or has had a fever, vomiting, or diarrhea within the prior 24 hours, do not book care or send them to a facility booking. We may refuse to provide care in those circumstances.
For medications: caregivers may administer medications only if you complete our medication authorization form and provide medications in their original labeled container. Caregivers cannot administer medications outside this process.
In a medical emergency, our caregivers are authorized to call 911 and seek emergency medical care for your child. You agree to be financially responsible for any emergency medical care provided to your child during a booking.
8. Photos and videos
Caregivers may take photos or short videos of your child during a booking and share them with you through the app. We won't use them for marketing, public posting, social media, or any other purpose without separate written consent. You can opt out of photos and videos for your child at any time by emailing us or updating your account preferences. See our Privacy Policy for details on how this content is stored and retained.
9. What's not allowed
You agree not to:

Use the Service for anything illegal.

Book care for a child who isn't in your legal custody or who you don't have authority to book for.

Misrepresent your child's age, medical condition, or behavioral history.

Attempt to hire any Poppins caregiver directly, outside the Service, during the term of these Terms or for 12 months after your last booking. Caregivers are our employees and we invest significantly in recruiting, training, and certifying them.

Reverse-engineer, scrape, or interfere with the app or website.

Submit content (notes, messages, photos) that's harmful, harassing, false, or violates anyone else's rights.
Violating any of this can result in immediate account termination.
10. Service changes and termination
We can change, suspend, or discontinue parts of the Service at any time. We'll give reasonable notice for material changes that affect existing bookings.
You can close your account at any time through the app or by emailing us. We can suspend or terminate your account at any time if you breach these Terms, behave in a way that's unsafe to our employees or other families, or repeatedly miss payments. If we terminate your account for breach, you remain responsible for any unpaid balances and any damages owed.
11. Disclaimers
We do our best to provide safe, reliable childcare. But we provide the Service "as is." Except as required by law, we make no warranties beyond those expressly stated in these Terms.
We don't guarantee:

That a specific caregiver will always be available for a booking.

That the app will be uninterrupted, error-free, or available at all times.

That all features will work on every device or operating system.
Nothing in this section limits any non-waivable consumer rights you have under Utah law, and nothing here disclaims responsibility for the care our employees provide while on duty.
12. Limitation of liability
To the fullest extent allowed by law, Poppins's total liability for any claim arising from your use of the Service is limited to the greater of (a) the amount you paid us for bookings in the 12 months before the event giving rise to the claim, or (b) $1,000.
We are not liable for indirect, incidental, special, consequential, or punitive damages, even if we knew they were possible.
This limitation does not apply to: death or personal injury caused by our negligence or the negligence of our employees during a booking; gross negligence or willful misconduct; or any liability that can't be limited under Utah law.
We carry general liability and professional liability insurance for our childcare operations.
13. Indemnification
You agree to indemnify and hold Poppins, its officers, employees, and agents harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: information you gave us that turned out to be inaccurate (especially about your child's health or behavior); your breach of these Terms; or your violation of any law or third-party right.
This doesn't apply to claims arising from our own negligence or that of our employees during a booking.
14. Dispute resolution
Before filing any formal claim, please contact us at info@poppinschildcare.com and give us 30 days to resolve the issue.
Governing law. These Terms are governed by Utah law, without regard to its conflict of laws rules.
Where disputes are heard. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Utah County, Utah, and you and Poppins agree to the personal jurisdiction of those courts.
No class actions. You and Poppins each agree to bring claims only on an individual basis, not as part of a class or representative proceeding.
15. Changes to these Terms
We'll update these Terms when our practices change. We'll post the new version with a new "Last updated" date. For material changes, we'll notify you in the app or by email at least 30 days before they take effect. Continuing to use the Service after a change means you accept the new Terms. If you don't agree, close your account.
16. Other things
Entire agreement. These Terms, plus our Privacy Policy and any booking-specific terms shown in the app, are the full agreement between you and Poppins about the Service.
Severability. If any part of these Terms is found unenforceable, the rest still applies.
No waiver. If we don't enforce a right or provision, that doesn't mean we've waived it.
Assignment. You can't transfer your account or rights under these Terms. We can assign these Terms to a successor (for example, in a sale or merger).
